Case adjourned a 5th time for 2 inmates accused of assaulting Dennis Oland in prison

For the fifth time, a judge has adjourned the case of two prisoners charged with assaulting Dennis Oland last summer at the Renous prison, where he was sent after being convicted of murder.

Case now adjourned until July 22 at 1:30 p.m. in Miramichi provincial court

For the fifth time, a judge has adjourned the case of two prisoners charged with assaulting Dennis Oland last summer at the Renous prison, where he was sent after being convicted ofmurder.

Convicted murderer Cody AlexanderMuise, 27,and Aaron Marriott, 26, in prison for attempted murder, appeared inMiramichiprovincial courtThursday afternoon to enter pleas.

They are accused of assaultingOlandat theAtlantic Institution inRenouson July 31, while he was serving a life sentence in the 2011 murder of his father, Saint John multimillionaire RichardOland.

Olandwas later released from prison later, after the New Brunswick Court of Appeal quashed the verdict and ordered a new trial.

The prison assault case had already been adjourned four times. During the men's last court appearance, on April 27, Marriott's lawyer requested more time to review the disclosure material the Crown's information in the case.Muise's lawyer asked to have the matter put off with Marriott's.

On Thursday, Marriot's lawyercontinued to ask for more time. He said his client had received a copy of his file and a DVD but was unable to view the DVD.

Muise's lawyer also asked for more time. Hehad not asked for a copy of the DVD but said hewould try to make arrangements to see it.

Judge Denis Lordon initially said the case neededto move along but then granted the additional time.

To return July 22

He adjourned the case until July 22 at 1:30 p.m.

No details about the alleged assault were released.

Because it occurred at a maximum security prison, the Crown is proceeding by way of indictment, rather than the lesser summary offence of assault. If convicted, each man would facea maximum sentence of five years in prison.
