Newfoundland and Labrador'sDepartment of Justice and Public Safety says it will be announcing the new superintendent of prisons in "the near future."

Former superintendent Graham Rogerson retired late in November.

In the meantime, assistant superintendentOwen Brophyhas taken over Rogerson's duties until the position is filled.

Brophy regularly filled in when Rogerson was on leave.

Brophy is named in a court application which alleges he and other senior staff at Her Majesty's Penitentiary in St. John's were criminally negligent in their handling a riot and attack inside the prison chapel in February.

Convicted killer Kenny Green was beaten and stabbed in a targeted attack.

Defence lawyers for two of the men accused in the attack allege in a Charter application that Brophyand other staff members knew the attack was planned but did nothing to prevent it from happening.

The lawyers saidBrophy"took responsibility" for the decision to allow inmates from units three and four to attend chapel together the day of the riot.

No date has been given for when the new superintendent will be named.
