Sarah Kucera loses $440K lawsuit against Qulliq Energy Corp.

Sarah Kucera, a former employee of the Qulliq Energy Corporation, has lost a civil lawsuit in which she sought $440,000 in damages for her constructive dismissal.

Sarah Kucera worked as the executive assistant to former QEC president and CEO Peter Mackey for about 14 months.

Her position was terminated in August of 2010.

During the trial in June of last year, Kucera's lawyer Phillip Hunt argued her work duties were reduced, and that her work environment was hostile.

The situation culminated in a letter sent by Kucera's lawyer on her behalf alleging she was constructively dismissed, and proposing a severance package be negotiated.

But Justice Cooper says the incidents Kucera cited fall short of what is needed to substantiate a claim of constructive dismissal.

Cooper agreed with QEC, saying the letter was not an attempt to resolve differences.

She found that Kucera had repudiated her employment contract, and as a consequence, was dismissed for cause.

Hunt said his client is disappointed with the results of the case, but he would not say whether she intends to appeal.
