Thomas Ted Barrett murder trial publication ban application dismissed

A judge in Sydney has dismissed an application to ban the publication of evidence at the second degree murder trial of Thomas Ted Barrett of Glace Bay.

The media will able to fully report details of a murder trial in Sydney this month after a judge ruled Friday it should not be subject to a publication ban.

Thomas TedBarrett, 40, will be tried Jan.18 forsecond-degree murder in the death of a21-year-old Glace Bay woman, Brett MacKinnon. She was last seen in 2006. Her remains were found in a wooded area of the town two years later.

Barrett'slawyer, Brian Bailey,asked for a publication ban earlier this week,arguingmedia coverage could taint potential jurors when Barrett goes on trial for the murder of another young woman this fall.

The lawyer for the CBC and the Cape Breton Post,David Coles, arguedthere is huge public interest in the case, and the second trial is many months away.

Nova Scotia Supreme Court Justice Robin Gogan dismissed the defence application Friday, saying there are measures in place to ensure an impartial jury.
