The former Congress leader was sentenced to life for the remainder of his natural life by the Delhi High Court on 17 December.
The hearing was adjourned because Kumar's main counsel did not appear before the court to cross-examine witnesses.
The Punjab CM, however, said that neither the Congress nor the Gandhi family had any role in the 1984 anti-Sikh riots.
The court has given Kumar time till 31 December to surrender.
Nath has been named in a report filed to the e Nanavati Commission and later to Justice Ranganath Mishra Commission to have been 'controlling' a mob during the riots..
